Dollar General Fired A Worker Because She Filed A Workers Compensation Claim – Thats a “Wrongful Termination” because that is pretty much the only reason in Alabama you can not fire someone

Colbert County, Alabama

A woman Fired for filing a workers compensation claim was awarded a $2 million verdict in Colbert County on April 9, 2010. The suit was brought against a Dollar General in Muscle Shoals by a former store manager of 33 years. Florence, Al attorney Joey James, of Bunch and James was her representation along with Jeff Kirby.

Shelia McCaig, of Muscle Shoals, sued after Dollar General fired her in late 2005 as a result of having filed a workers’ compensation claim.

James said his client was injured while on the job in 2004.

“Even after the injury, she returned to work at full duty and received three awards for excellence in performance, including a Chairman’s Circle award, which is only given to the top one percent of store managers across the country,”James said. Not only was Shelia doing the job Dollar General said she could not, Dollar General had given her awards for doing her job better than 99% of the store managers in the country doing exactly the same job.

“They say she was fired for not doing her job, but we believe it was retaliation for filing a worker’s comp claim.”

The case was heard in Colbert County Circuit Court in Tuscumbia, Alabama.
